The Terms and Conditions governing any given purchase will be those in effect at the date of your order. If you order goods after we have published the changes you will be bound by those changes.  To assist you in determining whether the Terms and Conditions have changed since your most recent order,  we will inform you promptly.

By placing an order on our website, you accept and are bound to the terms and conditions in force at that moment.

Settlement of the contract

The order placed on the website Surbir.it by the internet must be filled in each part and must contain the necessary elements to identify the Customer and the products ordered, as well as the indication of the delivery address, otherwise the ordered will be annulled.

Surbir.it will confirm acceptance of your order. This will occur by us sending an e-mail to the       e-mail address you have provided to us. The e-mail will contain also a reference to the applicable Terms and Conditions.

Characteristics of the products and their availability

In particular circumstances, Surbir.it may not be able to assure the availability of all the products offered and therefore it may not be held responsible for any temporary unavailability of one or more products. Except for what follows (Cancellation rights), the placement of the order by the Customer is considered as a full acceptance even of a partial delivery, limited to the available products amongst the ones ordered, as well as a renounce to the claim of any eventual refunding or compensation.

Surbit.it pledges itself, at rule of law, to inform the Customer of the eventual unavailability of the ordered product promptly. In case of order of purchase of products subjected to weight variation (the products are weighted and wrapped by Surbir.it after having received a specific order by the Customer) it can occur a variation between the quantity ordered and the quantity actually delivered, and as a consequence of this, a variation in weight and price may occur as well. The actual weight is determined at the moment of the preparation of the product and it may vary in range that goes up to 10% of the measure indicated in the order. If this last hypothesis may occur, the Customer will have to pay the price corresponding to the quantity of the product actually delivered, it being understood that the Customer will never be charged with a price superior to the one indicated at the moment of the order.

 

Cancellation rights

The Customer has the right to cancel the contract, without undergoing any penalty and without specifying the reasons, according to fairness and good faith. The Customer must inform Surbir.it of its withdrawal/change of order with an oral or written communication. In this communication the Customer will have to indicate the product or the products for which he wants to assert the cancellation right. Surbir.it will attend, at its own cure and expense, to the withdrawal of the product or of the products signalled by the Customer according to the modalities and terms that will have been previously agreed with the Customer, except for the Customer’s own renounce to return the above mentioned.

Shipping and delivery
Surbir.it  delivers the product or the products ordered by the Customer as stated explicitly in the section of the present website named as “Shipping and Delivery”.

Prices and methods of payment

The prices of the products indicated in each section of this website are inclusive of VAT . The prices applied are those indicated in the website at the moment of the placement of the order by the Customer. The prices of every single products are liable to changes and, therefore, each time the prices indicated on the website annul and substitute those indicated previously. The price of the products purchased, together with the cost of the delivery to the address provided by the Customer, will be paid by the Customer at the moment of the shipping in case of payment by credit card, while they will be paid by the Customer at the moment of the placement of the order in case of payment by bank transfer. All the receipt for fiscal purposes will be released by Surbir.it at the moment of delivery.

Warranty and Liability

Surbir.it, within the limits of availability as above disciplined, guarantees that products equal to the ones indicated and described in the website will be delivered to the Customer. Surbir.it guarantees the respect of all the rules attaining to the preservation of the products until they are delivered at the place indicated in the order.  The producer’s liability is applicable to all the products sold. In case of packed products the producer is liable also for the truthfulness and completeness of the indication reported on the package itself. The images present on the website are given to the Customer with the only purpose of simplifying the identification of the products; due to possible variation of the packages made by the producers, the pictures might not reflect the aspect of the product delivered in an exact manner.

Disputes and applicable lows

Civil disputes or controversy concerning the application, the execution and the interpretation of the contract of distance selling are subjected to Italian jurisdiction and the court of Reggio Emilia will be the cognizant court. The Italian law regulates all the contracts at distance entered into with Surbir.it and, for everything not explicitly stated in the contract, the in force rules of law for this matter must be considered the valid ones.
